The volume contains almost thirty papers by Kazimierz Twardowski, the founder of the Lvov-Warsaw School. The papers are published in English for the first time. The papers concern fundamental problems of philosophy: the methods of philosophizing, the boundary of psychology and semiotics, the conceptual apparatus of metaphysics, ethical skepticism, the question of free will and ethical obligation, the aesthetics of music and so on. Our claim in this paper is that not being identified as the data source might cause harm to a person or group. Therefore, in some cases the default of anonymisation should be replaced by a careful deliberation, together with research subjects, of how to handle the issues of identification and confidentiality. Our prime example in this article is community participatory research and similar endeavours on indigenous groups. The theme, content and aim of the research, and the question of how to (...) handle property rights and ownership of research results, as well as who should be in charge of the research process, including the process of creating anonymity, should all be answered, before anonymity is accepted. We agree with van der Pijl et al that the question of how to ensure consent is obtained for procedures which occur during labour and childbirth is vitally important, and worthy of greater attention.1 However, we argue that the modified opt-out approach to consent outlined in their paper may not do enough to protect the choice and agency of birthing people. Moreover, while their approach reflects a pragmatic attempt to facilitate legal clarity and certainty in this context, this is not (...) necessarily responsive to the messy realities of decision-making during labour (and beyond). We outline some of our concerns with their proposals and demonstrate how these illuminate some broader, longstanding tensions around consent and medical law. The authors place significant focus on the particularities of labour, outlining six ways in which maternity care is ‘unlike the usual healthcare setting’ (van der Pijl M et al,1p4). We support the need for attentiveness to these particularities and the problematic nature of consent in this context. Recent scholarly attention on the possible ‘political, ethical and theoretical implications and meanings of birthing embodiment’ (Chadwick R,2p2) has invited more nuanced conversation about consent, agency and decision-making during labour. However, while recognising the embodied particularities of labour, we must also avoid essentialising the differences of labouring bodies and thereby reinforcing exclusionary norms of consent. This article aims to provide a critical map of toleration as it is displayed in contemporary democracy. It does so by presenting three conceptions of toleration to which current practices of toleration can be traced, and, precisely, these are the standard notion, the political conception based on the neutrality principle, and toleration as recognition. The author argues that the latter is the appropriate conception to address the politically relevant issues of toleration arising in pluralistic democracy, while the first is adequate (...) only for social relations. In order to illustrate this argument, she presents a case of a contested and never solved request for a place of worship by the Muslims of Vercelli which represents an example of a very restricted and minimal interpretation of the standard notion, labeled ‘disrespectful tolerance’. The case is meant to show that unacceptable forms of toleration are still practised, and that the standard notion, here interpreted in the most minimal and negative way, is inappropriate for democratic politics. A reductive theory of collective intentionality would imply that the ‘official’ intentions of an oppressive political authority cannot be constructed from the intentions of individuals when they follow the authority's rules. This makes it difficult to explain the unraveling of official group plans through time in a seemingly consistent fashion, and the corresponding source of coercion. A non-reductive theory, on the other hand, cannot capture whether the actions of individuals in an oppressive society are free or coerced, so long as (...) a manifest institutional structure and rules are in place. I put forward a hybrid account of group intentionality that is capable of articulating why oppressive political power is illegitimate, which comes down to the official and individual intentions in joint group actions diverging in such a way that individuals are not governed on the basis of dependent reasons. Human and automated tutors attempt to choose pedagogical activities that will maximize student learning, informed by their estimates of the student's current knowledge. There has been substantial research on tracking and modeling student learning, but significantly less attention on how to plan teaching actions and how the assumed student model impacts the resulting plans. We frame the problem of optimally selecting teaching actions using a decision-theoretic approach and show how to formulate teaching as a partially observable Markov decision process planning (...) problem. This framework makes it possible to explore how different assumptions about student learning and behavior should affect the selection of teaching actions. We consider how to apply this framework to concept learning problems, and we present approximate methods for finding optimal teaching actions, given the large state and action spaces that arise in teaching. Through simulations and behavioral experiments, we explore the consequences of choosing teacher actions under different assumed student models. In two concept-learning tasks, we show that this technique can accelerate learning relative to baseline performance. (shrink)

In this paper, I revisit Kimberlé Crenshaw's argument in “Demarginalizing the Intersection of Race and Sex” (1989) to recover a companion metaphor that has been largely forgotten in the “mainstreaming” of intersectionality in (white-dominated) feminist theory. In addition to the now-famous intersection metaphor, Crenshaw offers the basement metaphor to show how—by privileging monistic, mutually exclusive, and analogically constituted categories of “race” and “sex” tethered, respectively, to masculinity and whiteness—antidiscrimination law functions to reproduce social hierarchy, rather than to remedy it, denying (...) Black women plaintiffs legal redress. I argue that in leaving the basement behind, deployments of “intersectionality” that deracinate the concept from its origins in Black feminist thought also occlude Crenshaw's account of the socio-legal reproduction of hierarchical power. According to the PCCP thesis, the probability of a conditional A → C is the conditional probability P. This claim is undermined by Lewis’ triviality results, which purport to show that apart from trivial cases, PCCP is not true. In the present article we show that the only rational, “Dutch Book-resistant” extension of the agent’s beliefs concerning non-conditional sentences A and C to the conditional A → C is by assuming that P = P. In other cases a diachronic Dutch (...) Book against the agent can be constructed. There is a tension between our findings and Lewis’ results, which needs to be explained. Therefore, we present a probability space which corresponds in a natural way to the diachronic Dutch Book—and which allows the conditional A → C to be interpreted as an event in a mathematically sound way. It also allows to formalize the notion of conditionalizing A → C on ¬C which plays a crucial role in Lewis’ proof. Our conclusion is that Lewis’ proof is circular, so it cannot be considered to be a sound argument against PCCP. (shrink)

Federal policies on human subjects research have undergone a progressive transformation. In the early decades of the twentieth century, federal policies largely relied on the discretion of investigators to decide when and how to conduct research. This approach gradually gave way to policies that augmented investigator discretion with externally imposed protections. We may now be entering an era of even more stringent external protections. Whether the new policies effectively absolve investigators of personal responsibility for conducting ethical research, and whether it (...) is wise to do so, remains to be seen. (shrink)

Although health matters are commonly discussed in various social contexts, health-related interpersonal communication still remains a black box in health communication research. Bringing together research from the fields of health communication and interpersonal communication, we therefore examine how people communicate about health and illness in their everyday lives. Based on Channel Complementary Theory and the concept of communication repertoires, we focus on a) the communication partners, b) the communication channels, and c) the communication patterns relevant to health-related interpersonal communication. We (...) conducted a qualitative study with 22 semi-structured online interviews combined with ego-centered network maps. Findings show that a) what is discussed with whom depends on the intimacy of the relationship, topic sensitivity, and partners’ personal characteristics, b) face-to-face communication is the preferred way of communicating, and c) (a-)symmetry of roles, (in)formality, and intimacy of the relationship influence communication. The paper aimed to reconstruct Twardowski's approach to the problem of free will and his analyses of the consequences of various solutions to this problem in ethics and criminal law. According to Twardowski, if we understand ‘free will’ as the possibility of making resolutions other than actually made, then (most probably) nobody has free will. Our resolutions are determined by a set of mental dispositions (character) and incentives that activate these dispositions. However, the existence of freedom of will such understood (...) is not a necessary condition for the correct functioning of ethical systems or criminal law. On the contrary, ethical systems and criminal law seem to assume that at least some of our resolutions are determined by our relatively stable dispositions. Only then can these resolutions and the actions that follow them be ascribed to certain agents. Twardowski's views on free will are presented here in the context of the metaphilosophical positions of the Lvov–Warsaw School, the central European branch of analytic philosophy. His position is also juxtaposed with Brentano's view of free will and Łukasiewicz's approach to the determinism/indeterminism debate. This juxtaposition illustrates the variety of philosophical positions and the diversity of the metaphilosophical toolkit applied in early analytic philosophy. (shrink)

Are colors features of objects “out there in the world” or are they features of our inner experience and only “in our head?” Color perception has been the focus of extensive philosophical and scientific debate. In this paper we discuss the limitations of the view that Chalmers’ (2006) has characterized as Primitivism, and we develop Marmodoro’s (2006) Constitutionalism further, to provide a metaphysical account of color perception in terms of causal powers. The result is Power-based Constitutionalism, the view that colors (...) are (multi-track and multi-stage) powers of objects, whose (full) manifestations depend on the mutual manifestation of relevant powers of perceivers and the perceived objects being co-realized in mutual interaction. After a presentation of the tenets of Power-based Constitutionalism, we evaluate its strengths in contrast to two other recent power-based accounts: John Heil’s (2003, 2012) powerful qualities view and Max Kistler’s (2017) multi-track view. In late 2003, the Canadian media reported that the Islamic Institute of Civil Justice would start offering arbitration in family disputes in accordance with both Islamic legal principles and Ontario's Arbitration Act of 1991. A vociferous two-year debate ensued on the introduction of “Sharia law” in Ontario. This article analyzes representations of Muslim women's agency that came to the fore in this debate by examining reports in three Canadian newspapers. The debate demonstrated two notions of agency. The predominant perspective conceptualized (...) Muslim women's agency as their ability to resist domination, tying secularization to agency. A second strain of the debate portrayed agency as embedded in intersecting social forces of domination and subordination. The first perspective homogenized diverse Muslim communities, fostering the gendered racialization of these communities. Understanding agency as embedded, by contrast, enabled conceptualizations of Muslim women as agentic religious subjects. (shrink)

Methodological nationalism is a cognitive bias that construes states as the natural and necessary form of contemporary social organisation. This gives rise to a state-centred view which naturalises national communities, exaggerates the differences between citizens and migrants, and exceptionalises international migration. In this paper, I argue that methodological nationalism is not only empirically inaccurate, but also normatively problematic, because its assumptions prevent migration ethicists from properly theorising about discrimination. I begin by briefly presenting methodological nationalism and clarifying some misconceptions. I (...) also identify some features that would make a policy discriminatory and show that many contemporary migration policies are discriminatory. Looking at three variants of methodological nationalism (naturalisation, territorialisation, and ignorance), I argue that methodological nationalism marginalises concerns about discrimination in migration ethics and prevents migration ethicists from developing accounts that would be able to counter xenophobic arguments. To do so, I explore the intellectual and creative narratives of individuals who, with tenure newly in hand, position themselves to engage with beauty and to pursue its meanings, expressed distinctively through the subjects, creations, and questions of scholarly disciplines and professional fields. In (...) interviews, scholars — professors with tenure in major research universities — described the sparks of beauty they experience in their scholarly work. For many, such moments of beauty, and often of deep engrossment, had recurred through life. Yet these were truly "moments": brief, bounded, hard to evoke, and by no means continuous, assured, or predictable. They were hard won. Many of the professors I interviewed referred to persistent struggles to craft scholarly agendas, communities, collaborations, and work lives that might invite the aesthetic glimmer, however brief. Many drew for insight and inspiration on childhood memories of beauty to guide their intellectual and creative pursuits in adulthood. They hitched present-day desires for moments of passionate thought to vivid memories — what they saw and felt in their earliest, often out-of-school encounters with an aesthetic they would pursue through their lives. Even now, in tenured university professorships, they relied on these deeply imprinted images to light their intellectual ways.1I also claim that scholars may experience aesthetic moments as deeply emotional and personal. This is not something I inferred; this is something the professors I interviewed said to me — directly, repeatedly, with emotion. [End Page 68] Yet I am something of an organizational realist, and the social sciences strand of my conscience impels me to pepper these scholars' accounts of recurrent beauty in their lives with less than beauteous recognition of a hard academic fact: that within the normative structure of academe, the personal (and emotional) meanings infusing professors' scholarly learning get short shrift. Public academic talk about the personal meanings of one's work, or the emotional content of study, is largely taboo. The press for institutional survival, social legitimacy, and financial and political gain typically call for presentations of scholarship as objective and outwardly directed, negating the personal origins of research in researchers' lives.2 Scholarly learning as an aesthetic awareness — as moments of fused insight and emotion, as dazzling sensations of coming to know, as frustration over ideas that unravel or that will not gel — is often lost in translation between the personal life from which it derives and the modern profession, career, and organization within which it is housed and enacted.I worry that this lost awareness of scholarly learning, occurring in large scale, forces questions about its social worth. Yet to persist, scholarly learning requires substantial social legitimation, appreciation, and support. I suggest further that this state of affairs calls for response: that to garner societal understanding for and support of scholarly learning as a setting for pursuits of beauty and as the communal mission of higher education, we must learn to talk out loud, and in educative ways, about it. However, we, as scholars and learners ourselves, must understand, first, what it is that we are defending and then represent its worth to publics who may learn to care about it. We must first define among ourselves what scholarly learning means, what it takes to engage it, and what it entails — cognitively, professionally, aesthetically, and emotionally. The changes in the subject matter of philosophical aesthetics are accompanied today by changes in evaluation, degradation of the traditional notion of beauty and also rejection of the old rigid division between beauty and ugliness, causing the dissolution of the category divides—in the process anti-value often becomes a value understood as a formal criteria. In the artistic critique the rejection of absolutism in favor of pluralism and diversity is accompanied by the functioning of the old categories in their new meanings. (...) One form of such anti-values is represented by the phenomenon of camp. As a specific kind of a paradox-figure, camp unveils the relation between aesthetization and anaesthetization.The new aesthetics is a dual figure, demanding examination of its two contrary aspects: aesthetical and anaesthetical. Camp’s rejection of the existing hierarchy of values, its admiration of what is not obviously ugly rather than of what is definitely not beautiful, brings this phenomenon close to Wolfgang Welch’s trend of anaesthetics. Environmental ethicists need to alter the ways we think and talk about what we value and the relations among ideas, values, and actions. Drawing on the sociology of religion and Marxian philosophy among other sources, a new approach may increase our understanding of how ideas are lived out and how we might increase the impact of our (...) ideas about the value of nature. Stakeholder maneuvers such as Internet media attacks or consumer boycotts can have devastating effects on companies. By contrary, vital relationships between companies and their stakeholders can be highly beneficial. A review of the existing stakeholder-management literature suggests to engage stakeholders in business activities in a positive manner. However, the types of successful engagement activities differ across industries. The purposes of this article are to develop an explanatory framework based on the literature findings, to introduce stakeholder-engagement literature to a segment of (...) the water sourcing industry, and to unfold industry’s stakeholder-engagement measures. Based on a content analysis of 11 cases, we investigate if and how companies in the natural mineral water bottling industry in Austria inform, communicate, and therefore engage with stakeholders. It became evident that fewer than three of eleven companies published information on sustainability or corporate social responsibility reports, open house days, workshops, or international community activities. Most companies maintained a website for their bottled natural mineral water or communicated quality consciousness. We conclude that most companies in the Austrian mineral water industry could increase their stakeholder-engagement activities to positively respond to challenging business environments. (shrink)
